Terms & Conditions
Effective 17 September 2026
These terms cover this website, the Harth Ops dashboard, our phone agents, and the Harth OS driver app. Where a client has signed a services agreement with us, that agreement wins on anything these terms also mention.
1. Who we are
Harth Solutions, ABN 33 789 586 073, a sole trader business in Victoria, Australia. Contact: harry@harthsolutions.com, 0473 923 634.
2. Using this website
Use it lawfully and do not try to disrupt it, scrape it or break into it. Anything on it about pricing, features or availability is general information and can change without notice.
3. Who the software is for
The dashboard and the driver app are business tools, not consumer products. There is no public sign up. Accounts exist only where a business has engaged us and its own office has created them, and each person's access is set by that business.
If you have been given a login by your employer, you may use it for that employer's work. Do not share it, and tell your office promptly if you lose the device it is on.
4. Your business's data stays yours
Everything a client puts into our systems, and everything captured on their behalf, belongs to that client. We store and process it to run the service, as set out in our Privacy Policy. We do not sell it and we do not use it to train publicly available AI models. A client can ask for an export or a deletion at any time.
5. Phone agents and recording
Our phone agents answer calls for clients and write down what the caller says. Some clients also record calls as audio. Whether recording is switched on is the client's decision, and it is the client's responsibility to meet the recording and notification laws that apply to them. We provide the capability and the means to disclose it.
An AI agent can mishear or misunderstand. Clients are responsible for checking anything that matters before acting on it, and our agents are built to read bookings back to the caller for that reason.
6. What the software does not promise
We work hard to keep everything running, and we do not guarantee uninterrupted service. The systems depend on third parties (telephony, hosting, mapping, accounting), and an outage at one of those can stop part of the service through no fault of ours.
Scheduling, pricing and availability answers are tools to help a business decide. They are not a substitute for the business's own judgement about what it can deliver.
7. Fees
Subscription fees, setup fees and what is included are set in each client's own agreement or written quote. Prices shown publicly are indicative. Nothing is charged inside the driver app, and the app contains no purchases.
8. Ending it
Either side can end an engagement on the notice in the relevant agreement. On the way out we will export the client's data to them, and remove it from our systems when they ask.
9. Our material
The software, the site, our branding and our designs are ours and stay ours. Nothing here transfers ownership of them. A client's own logo and content remain the client's, and we use them only to present their branded version of the product.
10. Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees paid to us for the service in the twelve months before the claim.
11. Other people's sites
We link to third party services and sites. We do not control them and are not responsible for them.
12. Changes
We may update these terms as the products change. The effective date above says when they last changed, and clients are told directly about anything material.
13. Law
Victorian law governs these terms, and the courts of Victoria have exclusive jurisdiction.
